Terms of Service

These terms apply when you use KCalorie Tracker (the “Service”). By creating an account, you agree to them. Please read the sections on estimates and health, and on billing, in particular — they describe real limits on what this app can do for you.
Who provides the Service
The Service is provided by KC APPLICATION (ABN 30 727 481 200), a sole trader registered in Australia (“we”, “us”). “KCalorie Tracker” is the trading name of that business. You can contact us at any time at info@keycornereducation.com.
Eligibility and your account
You must be at least 18 years old to use the Service. You are responsible for keeping your password confidential and for activity on your account. Tell us promptly if you believe someone else has accessed it.
You may delete your account at any time from Settings. Deletion is permanent and removes your logged data; it is not reversible by us.
Estimates, AI, and what the Service is not
The Service uses artificial intelligence to estimate the nutritional content of food from a photograph or a written description, to generate recipes and background information, and to write a weekly summary of your logging.
These outputs are estimates and can be wrong. Estimating a portion size from a single photograph is inherently imprecise, AI systems can produce confident but incorrect results, and figures for some nutrients are less reliable than others. Treat every number the Service produces as a guide, not a measurement.
The Service provides general wellness information only. It is not medical advice, not a diagnosis, and not a treatment. It is not designed or suitable for managing a medical condition, an eating disorder, or a pregnancy, and it must not be relied on for those purposes.
Do not use the Service to calculate insulin doses or the dose of any other medication. Carbohydrate figures in particular are estimates and are not accurate enough for dose calculation. If you count carbohydrates to dose insulin, use the method your treating clinician has given you.
If you have a health condition affected by diet, or you are making a significant change to how you eat, speak to a qualified health professional. Never disregard professional advice because of something this app displayed.
Free features and subscription
Much of the Service is free and requires no subscription, including logging meals by hand, barcode scanning, meal templates, weight, water and exercise tracking, your full history, and exporting your data. A subscription covers the AI features described on our Pricing page.
New accounts include a 7-day free trial of the AI features. The trial does not require payment details and does not convert into a paid subscription automatically — nothing is charged unless you choose to subscribe.
If a subscription ends or lapses, we do not delete your data and we do not make your account read-only. You keep the free features described above.
Billing
Subscriptions cost A$3.50 per month, are billed monthly in advance in Australian dollars, and renew automatically until cancelled. Payments are processed by Stripe; we do not receive or store your full card details.
If a payment fails, Stripe will retry it over a short period. We may suspend access to the paid features if payment ultimately cannot be collected.
Changes to the price
We may change the price of a subscription at any time, provided we give you at least 30 days’ notice by email before the new price applies to you, and you may cancel your subscription at any point before the new price takes effect. If you do not cancel before then, the new price applies from your next billing date after the notice period ends.
We do not promise that the price you start on is fixed for the life of your subscription. What we promise is notice and a real opportunity to leave before any increase reaches you.
Cancellation and refunds
You can cancel at any time from Settings → Subscription. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then. Our Refunds & Cancellation page sets out when we refund a payment and what to do about a charge you think is wrong.
Acceptable use
You agree not to:
- use the Service unlawfully, or to upload unlawful or infringing content;
- attempt to circumvent usage limits, access other users’ data, or disrupt the Service;
- scrape, resell, or systematically extract the Service or its AI outputs, or use it to build a competing product;
- upload photographs you do not have the right to upload.
We may suspend or close an account that breaches these terms.
Your content and shared recipes
You keep ownership of what you log and the photographs you upload. You grant us the permission needed to operate the Service — to store your content, and to send it to our processors so they can generate the estimates and text you have asked for.
If you choose to share a recipe, the Service creates a public link that anyone with the address can open, and which search engines may index. A shared page can include the food photograph and the recipe text. Sharing is entirely optional, and you can revoke a shared link at any time — though we cannot control copies or search-engine caches made while it was public.

Availability
We work to keep the Service running, but we do not guarantee that it will be uninterrupted or error-free. We may change, suspend, or discontinue features. If we discontinue the paid service entirely, we will give reasonable notice and refund any period you have paid for but cannot use.
Parts of the Service depend on third parties, including our AI provider, our email provider, and the Open Food Facts database. Their availability is outside our control.
Liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage.
Subject to that, and to the extent the law allows: we are not liable for indirect or consequential loss; we are not liable for decisions you make in reliance on an estimate the Service produced; and our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose.
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
Changes to these terms
We may update these terms. When we do, we will change the “Last updated” date above, and we will notify you by email of any change that materially affects your rights. If you do not agree to a change, you may stop using the Service and cancel any subscription.
Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of that jurisdiction have non-exclusive jurisdiction. If you are a consumer somewhere else, this does not deprive you of the protection of the mandatory consumer law of the place you live.
